Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy explains how PreventiveMD, Inc. and/or our affiliates (“PreventiveMD”, “we”, “us”, or “our”) collect, use, and disclose information about you when you access or use our Services. This Consumer Data Health Privacy Policy supplements the Privacy Policy and applies to personal information and other data that fall within the definition of “consumer health data” under applicable laws including, for example, Connecticut’s Data Privacy Act, Nevada’s Consumer Health Data Privacy Act, and Washington’s My Health, My Data Act.

We encourage you to review our Privacy Policy to learn more about our privacy practices and our commitments to you. Capitalized terms used below have the same definitions as in the Privacy Policy or in the applicable laws, unless otherwise noted.

This Consumer Health Data Privacy Policy does not apply to third-party websites or products. Please separately review their privacy policies to understand how your personal information is used and stored by those third parties.

Categories of Consumer Health Data We Collect

The “Personal Information We Collect” section of our Privacy Policy explains that we collect certain personal and health information about you depending on how you engage with our business. This health information can fall under the following specific categories of consumer health data, as defined by applicable law:

  • Individual health conditions, treatment, diseases or diagnoses, in connection with you seeking [healthcare] services [or medications] from or through PreventiveMD.
  • Social, psychological, behavioral and other medical interventions, through the collection of your medical history as part of the services you seek from or through PreventiveMD.
  • Health-related surgeries or procedures, through the collection of information regarding health-related surgeries or procedures within your medical history as part of the services you seek from or through PreventiveMD.
  • Use or purchase of prescribed medication, through your purchase of medication from or through PreventiveMD or through the medical history you provide to us and/or our partners.
  • Bodily functions, vital signs, symptoms or measurements of health, in connection with you seeking [healthcare] services or medications from or through PreventiveMD.
  • Diagnosis or diagnostic testing, treatment, or medication, through the collection of your medical history as part of the services you seek from or through PreventiveMD.
  • Reproductive or sexual health information, through the collection of your medical history as part of the treatment services you seek on or through PreventiveMD.
  • Data that identifies a consumer seeking healthcare services, through the collection of your medical history as part of the treatment services you seek on or through PreventiveMD.
  • Other information that may be used to infer, derive or extrapolate data related to the above or other information.

Sources of Consumer Health Data

As described further in the “Personal Information We Collect” section of our Privacy Policy, we collect information, which may include consumer health data, from the following sources: (i) directly from you; (ii) third-party sources; and (iii) automatically through the use of the Services.

Use of Your Consumer Health Data

We describe the purposes for the collection and use of your information, which may include consumer health data, in the “Use of Your Personal Information” section of our Privacy Policy. As further described there and subject to applicable law, we may collect consumer health data as directed by you or with your consent:

  • To deliver and operate the Services;
  • To personalize the Services;
  • To improve and analyze the Services;
  • For marketing;
  • For compliance and protection;
  • To combine with data collected from other sources;
  • To create aggregated, de-identified and/or anonymized data;
  • For scientific research and studies;
  • To facilitate corporate acquisition, mergers or transactions; and
  • For any other legal purposes.

Our Disclosure of Your Consumer Health Data

As further described in our Privacy Policy, and subject to applicable law (e.g., subject to your consent in certain situations), we may share your information, which may include consumer health data, with the following categories of third parties and affiliates:

  • Affiliates and subsidiaries (if any);
  • Health care providers and servicers;
  • Service providers;
  • Third parties designated by you;
  • Our partners;
  • Prospective sellers or buyers;
  • Authorities and others; and
  • Other entities in aggregate form.

When we share data with third-party service providers, we undertake commercially reasonable measures to ensure they safeguard personal data that they process on our behalf and respect privacy of such information in a manner substantially in accordance with the limits on use and sharing as set forth in our Privacy Policy.

As described in our Privacy Policy, we reserve the right to create aggregated and/or de-identified data from the information we collect through the Services and our disclosure of such aggregate and/or de-identified data is in our discretion.

PreventiveMD does not sell, lease, or rent your sensitive personal data, as those terms are traditionally understood. However, we may share your consumer health data with our advertising and analytics partners, with your permission as required by law.

Your Privacy Rights

As provided for in the “Your Rights” section of our Privacy Policy, you may make requests about your information. Applicable privacy laws provide you certain specific rights with respect to your consumer health data law subject to exceptions.

For example, Nevada and Washington residents have the following rights in relation to their consumer health data, subject to certain exceptions:

  • The right to know what categories of consumer health data we collect, share, or sell. You also have the right to obtain a list of all third parties and affiliates with whom we have shared or sold your consumer health data, and an active email address or other mechanism that you may use to contact these third parties. If you are a Washington resident or otherwise subject to Washington law, you also have the right to access your consumer health data that we collect, share, or sell.
  • The right to have us, as well as our affiliates, service providers, and contractors, delete the consumer health data we have about you.
  • The right to withdraw consent related to your consumer health data where we rely upon consent to collect, use, or share your consumer health data.
  • The right not to receive discriminatory treatment for the exercise of the privacy rights described above.

Connecticut residents have the following rights in relation to your consumer health data, subject to certain exceptions:

  • The right to know what consumer health data we collect, use, disclose, and/or sell or share as those terms are defined under applicable law. You may ask us to provide you a portable copy of this information up to two times in a rolling twelve-month period. You also have the right to access your consumer health data that we collect, share, or sell.
  • The right to have us, as well as our affiliates, service providers, and contractors, delete the consumer health data we have about you.
  • The right to opt-out of targeted advertising, the sale of your consumer health data, and profiling decisions that could produce legal or similarly significant effects concerning the consumer. You may designate an authorized agent to exercise your opt-out right.
  • The right to have us correct inaccurate consumer health data.
  • The right not to receive discriminatory treatment for the exercise of the privacy rights described above.
  • Rights concerning sensitive personal data. We cannot process your consumer health data, or use your consumer health data for certain purposes without your affirmative consent.

You may exercise your rights by contacting privacy@preventivemd.com with your request. As further stated in our Privacy Policy, your request may be denied where an exception applies, including but not limited to, where we are legally required to maintain your consumer health data or if we are unable to authenticate the request using commercially reasonable efforts.

We will respond to your request to exercise your right(s) within forty-five (45) days after receipt and we reserve the right to extend the response time by an additional forty-five (45) days when reasonably necessary and provided consumer notification of the extension is made within the first forty-five (45) days. As described further above, in some states, an authorized agent may submit a request to exercise the opt-out right on your behalf.

How to appeal decisions about your rights

  • Connecticut. If you are a Connecticut resident and your request is denied, you may appeal our decision and we will provide the steps to appeal as part of responding to your request. Within sixty (60) days of receipt of an appeal, we will inform you in writing of any action taken or not taken, including an explanation of our reasons in reaching the decision. If the appeal is denied, you may submit a complaint with the Connecticut Attorney General at https://www.dir.ct.gov/ag/complaint/ (opens in new tab).
  • Nevada. If you are a Nevada resident and your request is denied, you may appeal our decision and we will provide the steps to appeal as part of responding to your request. Within forty-five (45) days of receipt of an appeal, we will inform you in writing of any action taken or not taken, including an explanation of our reasons in reaching the decision. If your appeal is not successful, you may submit a complaint with the Nevada Attorney General at https://ag.nv.gov/Complaints/File_Complaint/ (opens in new tab).
  • Washington. If you are a Washington resident or located in Washington and your request is denied, you may appeal our decision and we will provide the steps to appeal as part of responding to your request. Within forty-five (45) days of receipt of an appeal, we will inform you in writing of any action taken or not taken, including an explanation of our reasons in reaching the decision. If your appeal is not successful, you may submit a complaint with the Washington State Attorney General at https://www.atg.wa.gov/file-complaint (opens in new tab).

Updates to this Consumer Health Data Privacy Policy

We reserve the right to change this Consumer Health Data Privacy Policy at any time to reflect changes in the law, our data collection and use practices, the features of our Services, or advances in technology. We will make the revised Consumer Health Data Privacy Policy accessible through the Services, so you should review it periodically. The date this Consumer Health Data Privacy Policy was last revised is identified at the top of the document. You are responsible for periodically monitoring and reviewing any updates to the Consumer Health Data Privacy Policy. If we make a material change to the Consumer Health Data Privacy Policy, we will provide you with appropriate notice in accordance with legal requirements. Your continued use of the Services after such amendments (and notice, where applicable) will be deemed your acknowledgment of such changes to this Consumer Health Data Privacy Policy.
